The Legal Metrology department is concerned with the issuance of the following licences at the state and Central level.
These licences are applicable to all the importers as well as manufacturers, importing or manufacturing any product that is responsible for Weighing or measuring any unit.
1. A brief description of model
2. Mark assigned to the approved model
3. Category of weight or measure
4. Brief statement of the test results
The department of Consumer Affairs has formulated stringent rules and guidelines for labelling of weighing and measuring instruments. All the labels of measuring instruments marketed in India must be compliant with the Legal Metrology mandatory declarations such as:
1. Name and address of the manufacturer /packer/ importer
2. Country of origin (for imported packages)
3. Month and year of manufacturer /packer /importer
4. MRP
5. Common or generic name of the commodity contained in the package
6. Net quantity (standard unit) must be approved and certified for every package
This LM registration needs to be taken within 90 days from the Inception of the business/ first transaction
Penalty for delay in registration is Rs. 25,000/- per director plus company.
The process of import licence can also be started soon after the model approval. Section 20 prohibits Import of any weight or measure without approval of model. An importer of measuring instruments, competing to do business in the Indian market needs to secure import licence from the Director of Legal Metrology, Government of India
The application along with the prescribed fee should be submitted at least one month before the import.
A person or a company included in trading and marketing of weights and measures stand-in need to the dealership licence, in addition to the import licence
Each approved weighing and measuring instrument must be stamped either by the state Legal Metrology officer or Respective District Legal Metrology inspector and must be tested and verified within the established standards.
Following validation, a stamp designating the year and respective quarter is laid down on each verified instrument
Lastly, a certificate of verification in accordance with schedule VIII of the Legal Metrology Act, 2009 is issued by the concerned officer
